There are two main ways mental health issues intersect with criminal prosecutions: 1. competency to stand trial and 2. insanity defenses. Here is an overview of those two features of the criminal justice system and why a "Foxitis" defense is not a legally viable defense in a criminal prosecution. However, the fact that defendants are saying they were inspired and incited to violence by the incessant lies of Donald Trump as repeated and amplified by Fox News should give the federal government, specifically the executive branch, every reason to regulate "news" outlets that peddle fiction as fact and should give the legislative branch reason to prohibit "news" outlets from peddling fiction as fact when it incites imminent violent conduct. Judge Amy Berman Jackson issued an opinion ordering the release of a Department of Justice Office of Legal Counsel memo and related DOJ internal communications that Bill Barr claimed factored into his conclusion that Donald Trump could not be charged for the obstruction of justice offenses documented in the Mueller report. Given the recent federal search warrants for Rudy Giuliani's home, office and electronic devices, it appears federal prosecutors may be moving in the direction of criminally charging Giuliani. The next big decision for Giuliani will be whether he wants to cooperate with prosecutors to bring others to justice. If anyone knows the value of cooperation it's Rudy Giuliani, a former US Attorney.  Also, might Trump secretly have granted Giuliani a pardon before leaving office? When federal prosecutors in New York previously tried to obtain search warrants for Giuliani's property they were blocked by the hierarchy in Bill Barr's Department of Justice. It now looks like the era of Bill Barr's free pass for Donald Trump associates is officially over as federal agents executed search warrants on Rudy Giuliani's home, office, computers and cell phones. Rather than use the available provisions of the North Carolina law to seek release of the videos that show the last minutes of Edward Brown, Jr's life, the Pasquotank County Sheriff's Office decides instead to show only 20 seconds of one (of 7) videos of the fatal shooting.
