Why the Trump Org Criminal Charges May Open the Indictment Flood Gates: A Matter of Precedent

Other countries prosecute their criminal leaders - Presidents, Prime Ministers, etc. For example, France, South Korea, South Africa and Italy have all prosecuted former leaders for crimes they committed while in office. However, in the United States there is no precedent for prosecuting a criminal former president. Prosecutors generally don't like to take maiden legal voyages, that is, bring a case that is unprecedented. Prosecutors like to have legal precedent as a blueprint. They like to have the comfort and cover of being able to point to an appellate court opinion - legal precedent - and say, "this has been done before, so I am not breaking new legal ground." However, logic and common sense dictate that, if you require precedent to indict a criminal former president then we could NEVER charge a criminal former president. Indeed, the way prosecutors create precedent is by doing something for the first time. The real question is - is there anything prohibiting the prosecution of a former president for crimes he committed while in office. The answer is a definitive NO - there is no law, no statute, no appellate court opinion and no Supreme Court precedent prohibiting the prosecution of a former president. This video discusses prosecutorial considerations in taking a maiden legal voyage - brining a novel case for which there is no legal precedent and relates example of when such novel legal cases have been brought in the courts of Washington, DC. Trump Org/Weisselberg Indictment Suggests Two Other "Trump Employees" Also Up for Possible Indictment

There is an ominous sentence on page ten of the Trump Organization/Allen Weisselberg indictment that suggests two other Trump Organization employees might be next in line for indictment. The sentence reads: “In addition to Weisselberg and his family member, two other employees received substantial amounts of compensation in the form of lodging in New York City and the payment of automobile leases.” You don’t need to read between the lines to realize that these two unnamed Trump Organization employees may have committed the very same crimes for which Weisselberg was just indicted. This begs the question, who else might have been so high up in the Trump Organization or so firmly entrenched in Trump’s inner circle that they might also have been part of the criminal scheme to defraud. There are certainly some Trump family members that would seem to fit that description. Any way you slice it, this language about “two other employees” being beneficiaries of the criminal scheme is a strong signal that future indictments are likely. NY District Attorney Vance/Grand Jury Set to Indict Trump Organization & Trump's CFO Allen Weisselberg Tomorrow

Several news outlets are reporting that the Trump Organization and its Chief Financial Officer Allen Weisselberg are going to be criminally indicted tomorrow by a New York grand jury. Although Trump himself is not expected to be indicted tomorrow, even Trump's lawyer, Ronald Fuschetti, said of tomorrow's indictment, "this will be their (the prosecutor's) first blow." Needless to say, this suggests that additional "blows" - additional indictments - are not far behind. NY District Attorney Trump Organization Indictment Watch - First Criminal Indictment Expected Soon. Won't likely be the Last

An alarming headline in Politico indicated that Trump's lawyers are saying New York District Attorney Cy Vance won't indict Donald Trump. However, Trump's lawyers then qualified their claim by saying that DA Vance told them Trump won't be indicted in the FIRST indictment expected to be handed down by the grand jury, but that the criminal investigation in ongoing. When prosecutors investigate large RICO/conspiracy/criminal organization cases, they almost always start with relatively modest indictments designed to leverage cooperation from the smaller fish. Prosecutors then build the case toward the larger criminal fish with a series of what are called superseding indictments.
