Reason for Optimism: Biden Rejects Trump's Executive Privilege Claim, Trump "Subverted" Constitution
President Joe Biden rejected Donald Trump's request that the White House invoke executive privilege to hide from Congress and the American people his (Trump's) misconduct in connection with the insurrection. But it's what Joe Biden said in announcing that decision that should instill confidence in the American that President Biden is intent on holding Donald Trump accountable for his misconduct. In a statement delivered by his White House Counsel Dana Remus, President Biden said, "Congress is examining an assault on our Constitution and democratic institutions provoked and fanned by those sworn to protect them," in other words, by Donald Trump. In rejecting Trumps' executive privilege request, President Biden conveyed that Trump's conduct "reflects a clear and apparent effort to subvert the Constitution itself."

Senate Report Reveals More Trump Election Crimes; What Congress Should Do About Witness in Contempt
The Senate Judiciary Committee must released a report titled, "Subverting Justice: How the Former President and His Allies Pressured DOJ to Overturn the 2020 Election." Among other crimes, the Senate details how Trump pressured acting Attorney General Jeffrey Rosen to overturn the election results. The conduct described in the report makes clear that Trump committed the crime of Coercion of Political Activity, 18 US Code section 610. This video reviews s the elements of that crime and how Trump's conduct violated the federal law prohibiting such coercion.
In a related story, October 7 was a deadline for Steve Bannon, Mark Meadows, Kash Patel and Dan Scavino to provide documents that had been subpoenaed by the House Elect Committee investigating the January 6 attack on the US Capitol. Trump & Bannon's Ongoing Conspiracy: Trump Tells Bannon to Defy Congressional Subpoenas
Donald Trump's crimes, cover-up and corruption continue unabated. The Guardian reports that Trump is preparing to instruct Mark Meadows, Steve Bannon, Kash Patel and Dan Scavino to commit the offense of contempt of Congress by refusing to comply with lawfully issued congressional subpoenas.
Considering that these four individuals can provide evidence that is likely to incriminate Donald Trump, Trump's command that they not testify is a transparent attempt at a criminal cover-up. Indeed, this is no different than a mob boss instructing his underbosses and capos not to testify against him.

House Select Committee Promises to Enforce its Subpoenas w/Criminal Contempt. Here's How That's Done
Members of the House Select Committee investigating the January 6 attack on the US Capitol have said in no uncertain terms that, if witnesses refuse to comply with congressional subpoenas they will refer those witnesses to the Department of Justice for criminal prosecution. This approach was unavailable to Congress during the tenure of Attorney General Bill Barr, as Barr was more interested in protecting a criminal president than he was in assisting Congress enforce subpoenas that sought evidence that could incriminate Donald Trump.

Two Insurrectionists Sentenced; Prosecutors Promise "Consequences" for those who "Incite Riots"
Two defendants were just sentenced to relatively short prison terms for participating in the attack on the US Capitol on January 6.
As reported by the Washington Post, there were two important aspects of the sentencing hearings: first, the defendants both said some version of, "I got swept up in the moment" and "I got carried away." What are the legal implications for the larger insurrection investigation of statements like this by defendants?
Second, the Department of Justice prosecutors told the judge that those who "incite riots" and "intend to improperly influence the democratic process . . . will (suffer) consequences." Why Weaponizing the Law is a Losing Republican Strategy; Republicans Seek to Defund Federal Police
The Republican Party has been trying to nefariously use the law in efforts to hold down, defeat and demoralize certain segments of the American populaiotn, from voter suppression laws to redistricting/gerrymandering to recounts/audits/fraudits and passing laws depriving women of their constitutionally protected privacy rights. However, this is NOT a winning formula for the Republican Party.
On a related from, the Republican Party is working at the moment to shut down government. I it seems to qualify as irony that the party that incessantly complains about the (largely nonexistent) defund the police movement is about to defund our 700,000 federal police officers.
