In an interview with the Today Show's Savannah Guthrie, Barr talks about the evidence of Donald Trump's criminal intent in connection with trying to corruptly overturn the results of the 2020 presidential election. The Daily Beast reported that New York District Attorney Alvin Bragg is refusing to release the resignation letters submitted by the two top prosecutors - Pomerantz and Dunne - who had been assigned to the Trump Organization prosecution and the criminal investigation into Donald Trump himself. Reports are that the letters criticize DA Bragg for his refusal to focus on the case in a timely manner and for his apparent determination to forgo indicting Donald Trump for his crimes. Troublingly, the NY DA's office is refusing to release the letters, claiming that the letters contain "too much information" and could compromise an ongoing investigation. This claim rings hollow. Are we to believe that the the two prosecutors included intimate investigative details in their resignation letters? Or is it far more likely that DA Bragg refuses to release them because the letters are deeply critical of Bragg's neglect of the case? This highlights a fundamental and recurring problem America has encountered in recent years: a lack of accountability for high government officials who have committed crimes coupled with a troubling lack of transparency as to why our law enforcement and prosecutorial agencies are refusing to hold those officials accountable for their crimes. The first criminal trial of a defendant charged with attacking the US Capitol on January 6, 2021, kicked off in DC federal district court on Monday, February 28, 2022. The defendant, Guy Reffitt, is charged with five felonies, including obstructing an official congressional proceeding, carrying a firearm and obstruction justice by threatening his own child in an attempt to prevent them from turning him in to the authorities. The Manhattan District Attorney's Officer had been steadily moving forward in its criminal investigation of the Trump Organization and Donald Trump. Indeed, that office indicted both the Trump Organization and Donald Trump's Chief Financial Officer Alan Weisselberg for charges including a 15-year-long criminal scheme to defraud in the first degree. But with the arrival of the newly elected District Attorney Alvin Bragg, the two top prosecutors on the Trump investigation abruptly resigned amid reports that the new DA was disinclined to indict Donald Trump. The Manhattan District Attorney's Office has now fired back, saying they have no intention of dropping the investigation into Donald Trump, and indentifying the new top prosecutor who will head up the 25-person-team involved in the Trump Organization prosecution. Her name is Susan Hoffinger. Ms. Hoffinger just joined the DA's office this month after being in private practice for decades. Attorney General Merrick Garland spoke directly and at length about the investigation into the attempted overthrow of our democracy on January 6. Garland pointedly said the Department of Justice will hold accountable all January 6 perpetrators "at any level", whether they were present at the Capitol" on January 6 or not. 2021 started with Donald Trump, on January 6, directing his supporters to go to the US Capitol and "stop" the certification of the election's results. Of course, he told them to stop the "steal", which provides definitive proof that Trump was lying to inspire and incite the attack, as his own administration officials and agencies said the election was not stolen. But if 2021 was the year of The Big Lie, 2022 will prove to be the year of The Big Truth. The House select committee investigating the Capitol attack has promised public hearings in early 2022. Committee Chairman Bennie Thompson has also indicated that the committee is considering criminal referrals for Trump and company. Moreover, the Department of Justice continues to investigate, indict and prosecute the foot soldiers of the insurrection, in what should be viewed as phase one of the Capitol attack investigation. Indeed, DOJ is following the standard prosecutorial blueprint in large-scale gang or RICO investigations: start at the bottom and work your way up the criminal ladder. Donald Trump is famous/infamous for using the courts for his own nefarious purposes - bringing baseless lawsuits to weaponize the delay in the court system and run out the clock. After losing in both the trial and appellate courts, Trump is now seeking to enlist the Supreme Court in his attempt to hide from the House select committee information in the possession of the National Archives regarding his conduct in connection with the January 6 attack on the US Capitol. Given that Supreme Court Justice Sonia Sotomayor recently used the work "stench" to describe the politicization of the Supreme Court, we now await word on whether the Supreme Court will accept review of Trump's latest appeal, thereby giving Trump the delay he seeks and adding to the court's political "stench," or reject Trump's appeal and allow Congress to fully investigate the attack on American democracy so it can put legislative fixes in place to prevent the next attack from succeeding.
