Last week, Colorado Judge Sarah Wallace entered a finding that Donald Trump engaged in an insurrection on January 6, 2021. However, Judge Wallace went on to rule that the 14th Amendment does not disqualify a president who engaged in an insurrection from again serving as president of the United States. Both parties have now filed appeals in the case. Trump has appealed the judge's finding that he engaged in an insurrection, and Crew - the organization that brought the suit on behalf of Colorado voters - appealed her ruling that Trump is not disqualified by the 14th Amendment. Glenn says one of the important factors in assessing the likely result on appeal involves the different standards of review that are applied to a trial court's factual determinations versus its legal determinations. Then, if you thought the New York fraud trial couldn't get any worse for Donald Trump - it just did. In a colossal tactical blunder, Trump's own lawyer put a witness on the stand that, as the Business Insider reported, "ties (Trump) to the conspiracy." Trump's lawyers called as a witness longtime comptroller for the Trump Organization Jeffrey McConney. After Trump had previously testified that he knew little to nothing about the annual net-worth statements of his own business, McConney testified that the statements were actually provided to Trump for his final review. Indeed, the attorney for the New York Attorney General's office cross-examined McConney with his own hand-written note on the financial documents that plainly stated, " DJT to get final review." Glenn says - in other words, Trump's own lawyers called a witness that blew up their client's defense. A three-judge appellate court panel heard arguments regarding the constitutionality of the gag order Judge Tanya Chutkan placed on Donald Trump in an attempt to prevent him from endangering witnesses, court staff, prosecutors and their family members. In a very spirited 2.5-hour argument, the judges had pointed questions for both the prosecution and the defense. A Colorado judge has ruled that the evidence presented during the course of a trial proves that Donald Trump engaged in an insurrection against the United States. Judge Sarah Wallace spends 95 pages of her 102-page ruling meticulously detailing the evidence supporting her findings that Trump did indeed engage in an insurrection. But in the last pages of her ruling, she says that while there "are persuasive arguments on both sides" of the disqualification issue, "it appears to the Court that for whatever reason the drafters of Section Three (of the 14th Amendment) did not intend to include (for disqualification purposes) a person who had only taken the Presidential Oath." And accordingly, Judge Wallace declined to find that Trump was disqualified from holding office in the future. In today's longform weekend podcast - Glenn begins with some good news and tells us why the color ORANGE used to be a favorite but now gives him the creeps. He explains the silver lining hiding behind the big dark cloud and talks about Judge Chutkan's determination to start Trump's election interference trial on march 4th. She set a date for Jury selection to begin on February 9th in Trump's trial for trying to overthrow the 2020 election. Glenn says he'll be in court that day to report on the proceedings. Next, "The boss is not going to leave under any circumstances. We are just going to stay in power." That's the quote from a proffer video that was leaked to the press and it could mean big trouble for Trump in his Georgia RICO case. After flipping and pleading guilty, Trump co-defendant Jenna Ellis provided videotaped statements to the prosecution. This was leaked to the press by another co-defendant's lawyer. Glenn says this testimony is really incriminating. Then finally, more on-again off-again gag orders for Trump. Glenn explains the details of the gag order "reflex" from the courts and it seems all of the gag order guardrails that keep Trump from saying or posting harmful things about court staff or witnesses are not holding in place due to the many appeals Trump keeps filing. One of the two gag orders judges have imposed on Donald Trump in attempts to protect witnesses, court staff and prosecutors, has been stayed or paused by the DC appellate court pending an oral argument scheduled for November 20th. As the reporting indicates, each of the three appellate court judges who will sit on the panel for the gag order appeal was appointed by a democrat president. In the age of Trump, we are always asking the question, "who appointed this federal judge?" But it hasn't always been that way. Glenn also takes on the differences between how the Obama administration approached the task of appointing federal judges versus how the Trump administration approached the same task. Then, in a remarkable revelation, one of Trump's co-defendants in the Georgie RICO case, Jenna Ellis, told prosecutors that Trump's close aid, Dan Scavino, said that Trump had decided he would not leave the presidency even though he lost the election. In today's weekend longform podcast Glenn gives us the latest updates in the Trump Trials. He begins with his review of the recent election. Then, Ivanka Trump has testified in the New York family fraud civil case. Glenn says it appears amnesia runs in the family. Then he talks about Special Counsel Jack Smith who has responded to a set of motions filed by the Trump legal team asking to dismiss the charges against him in Washington D.C. Glenn says Jack Smith shows that Trump's arguments are meritless. Next, a federal appeals court has temporarily lifted a gag order on Donald Trump in his 2020 election interference case in Washington D.C. Glenn says he'll be there on November 20th in the appellate court when they make their determination. Then finally, CNN has reported that several Mar-a-Lago employees are expected to testify against Donald Trump in his federal prosecution in Florida in his classified documents/obstruction of justice/espionage case. These witnesses reportedly include a plumber, a maid, a chauffeur, and a woodworker, among others. Upon learning of this, Trump erupted with an unhinged rant against the CNN reporting, against Jack Smith, and against Joe Biden.
