Military trials for homosexuality are treated far more seriously. The foundational legal texts, the mutiny act in the articles of war, do not list homosexuality as a crime. So you see people being described as having committed the unnatural act of sodomy. And all of those prejudices really come to play in terms of how the military courts operate on those questions.
