Is It Even Legal for Ukraine to Prosecute Prisoners of War?
If they were Russians or if they were people fighting on behalf of Russia, then I believe the detention authority that Ukraine would have for holding them would be under the laws of war. Is it even legal for Ukrainians to shift jurisdiction to the U.S. for criminal prosecution in that context? So it's an interesting question, and I am not certain of the specific answer to it. But from a Ukrainian perspective, they are simply local criminals who are defying the state.
