Sally Kohn: The argument that the employer brings ultimately does end up being essentially what the court says is the reason that they're ruling like, no, we can't do anything about this. So for instance, in victories brief, they write, there is simply no limit to how wide the net will be cast. Even limiting a duty of care to employers, household members, the pool of potential plaintiffs would be enormous, numbering not thousands, but millions of Californians. That's what capitalism does -- it has a tendency to kill and that's built into its structure.
