Are They Moving Increasively Enough?
The government has proved quite effective at expanding the scope of its power as long as it does so in a series of sufficiently incremental steps. The sheer volume of regulation that pours out of these dozens and hundreds of federal administrative agencies is mind boggling. There's something like 5000 congressionally enacted federal crimes and 300,000 criminal regulations. You can go to prison for engaging in conduct that no legislator ever said was impermissible.
