Alex Reiner: The government doesn't defend 1983 actions because those are necessarily state-based actors, but it does defend agents who are sued for things all the time. He asks whether there is a middle ground position in terms of deciding what cases to take on appeal and decide what cases totake to the Supreme Court. "I think they have the discretion to say, you know, even if we think there's a fair argument for qualified immunity here, we think the conduct is so egregious"
