There is no legally enforceable order at any level of the judiciary that would prevent the federal government from enforcing this eviction moratorium. The Justice Department has been doing an effective job of kind of jockeying for position in the lower courts, getting courts to either not issue an enforceable order or to vacate the order. President Biden has an independent obligation to uphold and defend the Constitution of the United States; he took an oath to do that.
