The Department of Justice has been asked to file an amicus brief in the DC Circuit Court of Appeals. The main issue that they're looking at is this case Nixon versus Fitzgerald, which basically held that during the term in office, a president has absolute immunity for unlawful conduct where it is within the outer contours of presidential power.
