Nudges are dependent upon having free choice. If you remove choice from the equation, say with a regulation or by banning something, you're no longer working in nudges and are outside of behavioral economics. One famous example of nudging is of how food is presented in a cafeteria. Putting the desserts at the front of the line makes it 25% more likely they will be chosen.
