The Justice Department would be pretty unlikely to prosecute under the criminal contempt of Congress statute. There could be no prosecution can go forward because to do so would sort of violate the separation of powers or violate this constitutional doctrine of immunity. And if they went for it, they also have the defenses that Trump could raise, which I think would be a very strong defense. It's given enough trouble with the case and that's not even close to being on point. So I find itVery unlikely, vanishingly small percentage of people who say there would be any movement to prosecute him for criminal contempt over these past few weeks.
