Is the AI Liability Directive a Necessity?
The Commission took two different approaches in these two proposals. The PLD has a strict liability regime that also applies to AI but it's limited to material damages and is limited to the manufacturer. The AI-LD if we can use that acronym is also covers fundamental rights and also covers users of AI but it is a different regime in the sense that it's fault-based.
