The question is whether these justices have enough integrity and principle to acknowledge that there are going to be situations where a program is unlawful, but nobody has raised sufficient standing to challenge it. It was very clear that Roberts and Kavanaugh do not like this program. And I don't know how this case will turn out. But the smart money has got to be that there are five votes to strike down this program.
