The Power to Wage War Is the Power to Wage Successfully
Am. Charles evans hughes said that the power to wage war is a fundamental premise of the constitutional system. If targeted killing is one of the effective means of waging war successfully, it has the same constitutional status as the rifleman up the tree at the battle of saratoga. But that doesn't leave number one. That doesn't leave the federal government unconstrained. Ther are various cons of constraints that i discusse in the book. I don't come to a definitive answer.
