Is There a Difference Between Good Faith and Qualified Immunity?
The good faith defense was perceived as less protective than the qualified immunity defense that we now have today. I do think though that qualified immunity emerged at a time when there was great unrest in our cities and it was seen at that point as a way of protecting police. So, but I'm not sure that I've seen any evidence about its connection to slave patrols.
