Is There Anything Special About Police Surveillance?
Sally Kohn: I have always been a fan of your theory of proportionality, which you've been writing about for years. Why is it so bad if you're investigating a triple homicide to allow more searches with less than probable cause because this is really important to solve? David Frum: My other answer would be that I think the Fourth Amendment is protecting against government intrusion. If what the police are trying to do is prevent a serious crime, then I think it's permissible to lower the justification level.
