Is Extraterritorial Criminal Jurisdiction a Good Idea?
After 9-11, Congress changed the law in response to the Guantanamo problem. People who are likely to fall into this category are not located within the United States. The question of actually hailing people into court for prosecution is a less obvious one. My view is that there is a pretty good policy debate to be had on whether that degree of extraterritorial criminal jurisdiction is a good idea.
