The Federal Nursing Home Reform Act FINRA Provides the Substance of the Rights Claim
The Tolefsky family is suing under section 1983 and the Federal Nursing Home Rights Act FINRA. Section 1983 provides access to federal courts such that a person who believes their rights were violated could make a claim for redress. The idea here again is that if an entity is going to receive this federal Medicaid funding, then it must agree to certain conditions.
