Trump declared his candidacy for president very early and that was the trigger. The DOJ under Merrick Garland had been resistant to even starting a probe into Trump, let alone indicting him as Smith did. If Trump had announced later, like typical candidates, if he'd used the typical announcement window, well, Jack Smith appointed, right? But the policy says prosecutors cannot indict or make other actions close to elections.
