Does Congress Really Abrogate State Sovereign Immunity?
In the dissent, justice thomas says that usera itself does not explicitly abrogate state sovereign immunity. Justice bryor says that's not actually true. He points to a bunch of pages but it does seem that under your theory, where the states, you know, under the original constitution, understood they did not have any sovereign immunity. Is it necessary for congress to clearly abrogated state sovereign immunity? That is an incredibly difficult question.
