I'm Not Sure if the Court's Going to Kick the Door Down in Terms of What Is Actually Available.
I don't think there actually is that much of a circuit split here, but you have very vocal people expressing discontent with this kind of position. We saw Judge Bareson do the same thing in the lower court in the Ninth Circuit in this case. I'm just not sure that's right, that they're going to slash and burn their way through all the existing precedent. Even our justices who are not probably the most online people on the face of the planet have a strong sense of this.
