Major Question's Doctrine
The court had never used the term major questions doctrine before. The last place one would expect to find it is in the previously used backwater section of one 11. This case seems really obvious to me because of the backwater aspects of an agency saying, we want to do this. That's a sort of vague br odd language. Let's make this catch all provision now a huge part of what we do. I still think major question's doctrine makes a lot of sense.
