The practical effect of this is it's going to take months for the case to go through the merits process at the Fifth Circuit Court of Appeals and then probably come back to the Supreme Court. My sense is that the justices on the Supreme Court don't mind being out on a limb in a legal sense; they're just whining about procedural stuff.
