The Fourth Amendment and the Courts

The courts are not set up to do the sophisticated job of regulation that we need if we're going to have technological policing. The constitution, at least as interpreted until now, doesn't directly address a lot of the issues. So I think legislatures are better situated to deal with those kinds of issues. It doesn't mean the courts can address them. And I wish the courts would make more pronouncements in general terms on these points.
