She says an appellate court in DC asked the Department of Justice to weigh in and say, well, are these defenses put forward by Donald Trump legitimate at all? Kohn: The DOJ finally answered the appellate court and said absolutely not what he said that day is not within the scope of his job. This means that the DOJ has essentially knocked down whatever defense Trump will have, if and when, they criminally charge him for incitement of a riot she says.
