Is There a Better Purpose Test?
There was a lot of talk about purpose being no good and effect being the way to go. But it sounds like really what we are talking about is a better kind of purpose test, an objective purpose test? I think that we need to see how this section forty six plays out before we'd jump in and change it over again. The amendment has brought us closer to those other laws overseas, but across different countries, we see different kinds of approaches to single firm conduct.
