The SIPA Process in the Case of a Sensitive Document
The government is going to have to prove that it is in fact classified, but whether or not it's appropriately classified is not really a defense in this case. One thing that SIPA does allow for is that a document doesn't have to be declassified if it's going to be shown to a jury. The 11th Circuit can then overrule the district court.
