The Losingness of the Case in Colorado
David Bianculli: In some ways, this seems to be a solution in search of a problem. He says the Virginia v. Black case is worth a read; he doesn't think it's as bad as Justice Thomas' dissent. BiancullI: We're looking at two plus months until we see a decision here. I hope that the losing-ness will still encompass this behavior in question.
