Infringement of a Patent

Infringement includes literal infringement of a patent, meaning they are performing a prohibited act that is protected against by the patent. In some countries there is liability for contributory infringement - participating in another's infringement. There is also inducement to infringement, which is when a party induces or assists another party in violating a patent. An accused infringer has the right to challenge the validity of the patent allegedly being infringed in a counterclaim. A patent can be found invalid on grounds described in the relevant patent laws, which vary between countries.
