FINRA - Is Section 1983 a Good Option?
The court has said there's this three pronged test for how specific Congress had to be about rights set forth in that kind of statute before they can be privately enforced using section 1983. The asserted right must not be so vague and amorphous that its enforcement would strain judicial competence. And then the provision given rise to the asserted right must be couched in mandatory rather than prechatory terms.
