The exempt classification is really pertaining only to the FLSA, Federal Labor Fair Labor Standards Act. But employer employers can choose to offer non-exempt employees benefits if they want to. There aren't any state rules for the most part. They run the risk of really pissing off other employees who may find out that James is getting benefits and then they're not.
