What's the Right Degree of Liability for Law Enforcement?
Lawrence Lessig: The idea of some degree of qualified immunity makes a certain intuitive sense. A cop who is just doing his job complying with the rules, somebody gets hurt, should not be individually liable he or she couldn't reasonably have been expected to know anything about. He says if we're in a world where officers truly were subject to personal liability, then I understand your intuition. But that's not the world we live in,. So long as we keep those protections in place, there's a middle ground, which is what we used to have before we moved to this clearly established law.
