Nash: How are qualified immunity cases being resolved? And what are the variables that seem to determine that? Nash: We called about 4,000 more than 4,000 qualified immunity decisions over the course of about 10 years in the courts of appeals. He says there was wide variation in the extent to which particular courts of appeals within the United States engaged in this asymmetrical review for some of them.
