Unfair Contract Terms Can Be Declared Void
The most that can happen at the moment is that a term will be declared void. But for that to happen, some one has to take the company to court. So if i'm an inhouse counsil and i've got a consumer contract, i would say to my ceo or my board, look, there's a clause in here that arguably is unfair but don't worry too much. If it is unfair, we will hear about it from people who want to take us to court, or complain to the atriple s to claim that it's unfair. And the worst that's going to happen to you is that it will be declaredvoid and it will be of no effect
