The Usefulness of Constructive Trusts

The court can set aside a gift or disposition where the transfer was made by mistake. The property must have been transferred by deed not an oral agreement. Usefulness of constructive trusts is limited as they are only available in certain circumstances. In Rainer v Preston, the claimant had purchased a house from the defendant but it was then destroyed before they could move in.
