The Unforeseen End of the North Carolina Supreme Court Case
There's really literally at this point, the appealing party has now won the case. They can just get rid of it. And for any justice who was working on a majority opinion or a dissenting opinion, they can now issue it as a statement regarding the disposition of the case. It is highly unusual after a final judgment to just go ahead and reopen the case and issue a brand new final judgment because you've got a partially new court composition.
