Is That the Same Argument That States Make in the Affordable Care Act Case?
In 1981 Supreme Court case, William Nyquist articulates this and it's a conservative court. He is basically setting forth what would come to be known as a clear statement rule in this context. The doctrine was developed in the context of thinking that the federal government enjoyed too much power over states. It's a doctrine that tries to kind of recalibrate the balance there.
