The Second Circuit's Fast Track on Oral Argument
It's very unusual to have a case like this in the first place. Normally when Congress issues the subpoena the recipient of the subpoena doesn't have the option of going to court because under the speech of debate clause the committee is immune from being sued for its official legislative activities. The reason this case is different is that the party that received the subpoena is different than the party that is asserting the interest. I think we will see I think in the oral argument on Friday one whether the judges are interested in this question of impeachment and why there has been no impeachment.
