What Are the Key Benefits to an FTO Designation?
The sanctions regime, which is pretty robust that we already have in place, is an economic penalty rather than the possibility of criminal prosecution. The Supreme Court has made very clear that even material support that is given to a designated FTO for humanitarian purposes would still constitute material support under the statute. And so I think that's right, that it's this broad jurisdictional power over foreign nationals that material support is defined so broadly.
