Is the Fourth Amendment a Law Enforcement Policy Thing?
There's been a sort of doctrinal erosion of transparency protections, how much of that has to do with evolutions and fourth amendment jurisprudence? And how much of it has to do. with law enforcement seeing that and using certain investigative techniques that skirt around that, rightly? Well, i guess i would say it's both. I don't think that these are particularly new evolutions in doctrine. Rght, soi starting with terry versus ohio, we see the emergence of a strain of doctrine that basically facilitates warrantless searches based on reasonable suspicion. Starting in the 19 sixties. We see the evolution of policing based not on a search warrant base on probable cause
