Qualified Immunity - What Are the Basic Criticisms of It?
qualified immunity is an entirely judge made doctrine that Congress could presumably change tomorrow if it wanted to. It comes from the Supreme Court was interpreting a federal statute, 42 USC, Section 1983. Since the statute, when someone brings an action for violations of their civil rights, it's almost always brought under Section 1983. And as you say, because it's a question of statutory interpretation, not a question of the Constitution, Congress could abolish it tomorrow.
