There are two components to this. First is, did he have the right to act to begin with? And what we have to look at is how reasonable was it? What was he responding to? There were other people involved when Mr. Penny was still holding onto Jordan Nealey on the ground. Do you want to see any charges against them? Absolutely. I asked the DA whether they identified those two people yet, and the answer was no.
