The Department of Health and Human Services, in This Case, Is a Legislative and an Executive Function in One

Nichol i got it cut in here. How would this possibly be a problem for school boards? I mean, eric schmidt is threatening them with legal action over this ruling. So the what the judge says is, you can't give arbitrary discretion togh. They can't delegate something that has arbitrary discretion. That's not allowed because that's giving legislative and executive function in the same body.
