First Amendment - Is This a First Amendment Amendment?

The first amendment arguments, a good one, butit does it right. I actually think bill may be right on the immediate outcome. But i think, from a practical perspective, this is eventually something that would have to go to the supreme court,. or it could be a legislative change before it even gets to the court.
