MRI to Assuage Trademark Disputes
University of Virginia marketing professor Zhi Hao Zhang tried scanning the brain to look for evidence of trademark confusion. His team relied on an effect called petition suppression where a brain response becomes weaker the more times it responds to the same thing. A judge would use this as one factor to determine if there was brand confusion, at least they could.
