Is There Any History of Qualified Immunity for the State Cause of Action?
This is effectively passing a version of the same cause of action that exists at the federal level. So if you sue in federal court, you'll get a 1983 defense, a qualified immunity defense. If you sue in state court under state law, that defense is not available on the same set of facts. There would be no qualified immunity for the claim brought under state law.
