Mueller offers ten different examples of potential obstructive conduct and on some of those he does offer mixed fact and mixed law right is firing Comey. It's pretty clear Trump's efforts to get Jeff Sessions to unrecuse himself was not within there's that's not a legitimate article to function none of the defenses are sort of relevant to that point. His efforts to get Don McGahn to lie about whether or not he had instructed McGahn to instruct Sessions to fire a Mueller doesn't raise difficult questions of law in fact so it's clear that yes for some buckets here there potentially there's a close call but there are at least two or three of these in which at least taking Mueller's report
